Drivyn Detailing – Terms of Service
Term
This agreement becomes effective on the date the client accepts a quote, books an appointment, or receives services from Drivyn Detailing and will remain in effect until terminated as outlined below.

Scope of Services
The services provided will be as outlined in the estimate, invoice, booking confirmation, or agreement between the client and Drivyn Detailing.
Additional services requested by the client beyond the original quoted package may result in additional charges. Any major service additions will be discussed with the client prior to completion whenever reasonably possible.
Drivyn Detailing reserves the right to refuse or discontinue service if conditions are determined to be unsafe, unsanitary, hazardous, or beyond the scope of standard detailing services.

Payment Terms
Payment is due immediately upon completion of services unless otherwise agreed upon in writing.
Accepted forms of payment include cash, debit card, credit card, digital payment applications, or electronic transfer.
Invoices not paid upon completion will be considered overdue.
Deposits for appointments, specialty services, or large projects may be required and are non-refundable unless otherwise stated.

Late Fees & Justification
Drivyn Detailing incurs upfront costs including labor, fuel, cleaning chemicals, water supply, travel expenses, and equipment maintenance. Late payments create financial hardship and disrupt scheduling and business operations.
To ensure fairness, the following late fees will apply:
A 10% late fee will be applied if payment is not received within 7 days of the invoice date.
An additional 10% late fee will be applied for each additional 7-day period thereafter.
If payment is not received within 15 days, future appointments may be canceled or suspended, and Drivyn Detailing reserves the right to pursue collection proceedings or legal action if necessary.
The client agrees to pay any reasonable collection costs, court fees, or attorney fees associated with unpaid balances where permitted by law.

Vehicle Specific Terms
Excessive pet hair removal will result in an additional charge due to the significant labor and time required.
Pet hair pricing may vary depending on severity, seat material, carpeting, and overall vehicle condition.
Drivyn Detailing does NOT clean feces, urine, vomit, blood, mold, needles, bodily fluids, biohazards, or other hazardous waste materials.
If bodily fluids, feces, excessive mold, drug paraphernalia, insects, maggots, or hazardous materials are discovered during the detail, service may be immediately stopped and canceled without refund of any deposit paid.
Vehicles requiring biohazard remediation or specialized sanitation services are outside the scope of standard detailing services.
Excessively dirty vehicles may be subject to additional charges including but not limited to excessive sand, mud, stains, spills, oxidation, salt buildup, smoke residue, or trash removal.
Child car seats will not be removed or reinstalled by Drivyn Detailing due to liability concerns. Clients are responsible for removing car seats prior to service if cleaning beneath them is requested.
Loose personal belongings, valuables, firearms, cash, electronics, and important documents should be removed before the appointment. Drivyn Detailing is not responsible for lost, stolen, or damaged personal items left inside the vehicle.
While reasonable care is taken, Drivyn Detailing is not responsible for damage resulting from pre-existing conditions including cracked leather, worn upholstery, loose trim, faded plastics, brittle surfaces, failing paint, aftermarket installations, or previously damaged components.
Some stains, odors, scratches, paint defects, pet hair, water spots, or interior contamination may not be fully removable. No guarantee is made regarding complete restoration unless specifically agreed upon in writing.
Engine bay cleaning is performed at the client’s own risk. Drivyn Detailing is not responsible for pre-existing mechanical issues, electrical problems, warning lights, or component failures that may occur after engine bay cleaning.
Ceramic coatings, waxes, sealants, and protectants require proper maintenance by the client after application. Longevity may vary based on weather conditions, washing habits, and environmental exposure.

Mobile Service & Access
The client must provide safe and lawful access to the vehicle at the scheduled appointment time.
If the vehicle is locked, inaccessible, located in a restricted area, or otherwise unavailable upon arrival, a cancellation or rescheduling fee may apply.
The client is responsible for ensuring the vehicle can legally be serviced at the chosen location. If local ordinances, apartment complexes, HOAs, parking authorities, or property owners prohibit detailing services, Drivyn Detailing is not responsible for any resulting issues or fines.
If severe weather, unsafe working conditions, or environmental hazards prevent services from being completed safely, the appointment may be rescheduled.

Scheduling & Arrival Windows
Appointment times are estimates and may vary due to traffic, weather conditions, prior job delays, or unforeseen circumstances.
Drivyn Detailing will make reasonable efforts to communicate delays or scheduling changes.
Clients arriving late to appointments or failing to appear may forfeit deposits or be subject to cancellation fees.

Fuel Surcharge
A fuel surcharge may be applied during periods of significant fuel price increases, especially for appointments outside the standard service area.
Travel fees may also apply for locations outside the normal operating radius.

Property Conditions
The client is responsible for ensuring the work area is reasonably safe and free from hazards including aggressive animals, unsafe surfaces, construction hazards, or dangerous conditions.
Drivyn Detailing is not liable for damage caused by unstable electrical outlets, poor water supply, unsafe property conditions, or pre-existing environmental hazards.

Weather Disruptions
Mobile detailing services are weather dependent.
If rain, snow, lightning, high winds, freezing temperatures, or severe weather conditions prevent service completion, appointments may be delayed, paused, or rescheduled.
Refunds or credits will not be issued for weather-related delays unless the service is permanently canceled by Drivyn Detailing.

Satisfaction Policy
Drivyn Detailing strives to provide high-quality detailing services performed according to industry standards.
If the client believes an issue exists with workmanship, the client must notify Drivyn Detailing within 24 hours of service completion.
Reasonable attempts will be made to correct verified workmanship issues at no additional charge.
Issues resulting from normal wear, permanent staining, oxidation, clear coat failure, neglect, pre-existing damage, or unrealistic expectations are not covered.

Photography & Marketing
Drivyn Detailing may photograph or video vehicles before, during, and after services for documentation, training, insurance, or marketing purposes.
License plates and personal identifying information will make reasonable efforts to be concealed when practical.
Clients may request in writing that their vehicle not be used for promotional purposes prior to service.

Liability & Insurance
Drivyn Detailing maintains general liability insurance as required by law.
However, the client acknowledges that detailing involves working on vehicles with pre-existing wear, defects, and fragile materials.
Drivyn Detailing is not responsible for:
Pre-existing damage
Mechanical failures
Electrical malfunctions
Wear revealed during cleaning
Damage caused by aftermarket accessories
Damage due to improperly installed parts
Normal deterioration of materials
Any claims for damage must be reported before the vehicle leaves the service location or within 24 hours of completion.

Cancellation & Termination
Clients may cancel appointments at any time.
However:
Deposits are non-refundable unless otherwise stated.
Same-day cancellations may be subject to a cancellation fee.
No-call/no-show appointments may result in refusal of future services.
Drivyn Detailing reserves the right to refuse or terminate service for abusive behavior, unsafe environments, unsanitary conditions, harassment, illegal activity, or any circumstance deemed inappropriate.

Independent Contractor
Drivyn Detailing is an independent contractor and is not an employee, agent, or partner of the client.
Nothing in this agreement creates a partnership, joint venture, or employment relationship.

Indemnification
The client agrees to indemnify and hold harmless Drivyn Detailing, its owners, employees, contractors, and affiliates from claims, liabilities, damages, expenses, or losses arising from:
Unsafe conditions at the service location
Pre-existing vehicle defects
Improper vehicle maintenance
Client negligence
Third-party actions unrelated to detailing services

Limitation of Liability
Drivyn Detailing shall not be liable for indirect, incidental, special, punitive, or consequential damages including but not limited to:
Loss of vehicle use
Loss of income
Loss of business
Rental expenses
Towing expenses
Mechanical breakdowns unrelated to workmanship
Delays caused by traffic, weather, suppliers, or emergencies
Maximum liability for any claim shall not exceed the total amount paid by the client for the specific service provided.

Jurisdiction
This agreement shall be governed by the laws of the State of Ohio.
Any disputes arising under this agreement shall be resolved in the courts of Cuyahoga County, Ohio.

Dispute Resolution
Both parties agree to first attempt to resolve disputes through good-faith communication.
If resolution cannot be reached, disputes may be submitted to mediation or arbitration prior to formal legal proceedings where permitted by law.

Force Majeure
Neither party shall be held liable for delays or failure in performance caused by circumstances beyond reasonable control including but not limited to:
Severe weather
Floods
Tornadoes
Fires
Power outages
Equipment failure
Supply shortages
Labor shortages
Government restrictions
Pandemics
Civil unrest
Accidents
Acts of God

Acceptance of Terms
By booking services, accepting a quote, making payment, or allowing services to begin, the client acknowledges that they have read, understood, and agreed to these Terms of Service in full.
